This website is operated by Arca Lab (referred to as "we", "us" or "our"). By accessing or using this website or placing an order, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website.

6.5 No Quality Guarantee Beyond ACL. We do not warrant that product quality will meet your subjective expectations. Your statutory rights under the Australian Consumer Law (ACL) are not affected by this clause.

To the maximum extent permitted by law, Arca Lab and its directors, employees, agents, and contractors are not liable for any indirect, incidental, punitive, special, or consequential damages (including loss of profits, loss of data, or business interruption) arising from your use of the service or our products. This limitation does not apply to any liability that cannot be excluded under the ACL.
14.4 Cap on Liability. Where our liability cannot be excluded, our total liability to you is limited to the lesser of: (a) the cost of replacing or repairing the relevant goods; or (b) the amount you paid for the relevant product.
SECTION 15 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Arca Lab and its affiliates, officers, directors, employees, agents, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; or (c) your violation of the rights of any third party.
SECTION 16 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remainder of these Terms will continue in full force and effect.
SECTION 17 — TERMINATION
17.1 Survival. All obligations and liabilities incurred prior to termination will survive any termination of these Terms.
17.2 Termination by You. You may terminate these Terms at any time by ceasing to use the site and notifying us that you no longer wish to use our services.
17.3 Termination by Us. We may terminate your access to the service at any time, without notice, if we reasonably believe you have breached these Terms. Termination does not release you from amounts owing to us as at the termination date.
SECTION 18 — ENTIRE AGREEMENT
These Terms of Service, together with our Privacy Policy, Refund Policy, and any other policies published on this site, constitute the entire agreement between you and Arca Lab regarding your use of the service and supersede all prior agreements, representations, and understandings.
Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right. No ambiguity in these Terms shall be construed against us as the drafting party.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You and Arca Lab submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia.
